Terms of Service

These Terms of Service ("TOS") govern your use of the hosting services provided by Ryft ("Ryft," "we," "us," or "our"). By accessing or using our services, you agree to comply with these terms and conditions.

1. Age Restrictions

1.1. By using our services, you represent and warrant that you are at least 13 years of age. If you are under 13 years of age, you are not permitted to use or access our services.

1.2. If you are between the ages of 13 and 18, you may only use our services with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms of Service.

1.3. We reserve the right to request proof of age at any time to verify compliance with these age restrictions.

1.4. Any violation of these age restrictions may result in immediate termination of your account and access to our services.

2. Account Setup and Security

2.1. You are responsible for maintaining the security and confidentiality of your account credentials. You agree to immediately notify Ryft of any unauthorized use or breach of security.

2.2. You are solely responsible for all activities that occur under your account. Ryft shall not be liable for any loss or damage arising from your failure to comply with this section.

2.3. Custom domains: You may upload a certificate chain and private key for a hostname you control. You represent that you are authorized to use that hostname and certificate material. You are responsible for obtaining, protecting, and renewing the certificate before it expires. Ryft validates and installs supplied material but does not act as its certificate issuer or renewal provider, and may reject invalid, mismatched, expired, or unsupported certificate material.

3. Service Usage and Restrictions

3.1. You agree to use Ryft's services in compliance with all applicable laws, regulations, and these terms.

3.2. You shall not engage in any activity that may disrupt or interfere with the proper functioning of Ryft's services or networks.

3.3. Ryft reserves the right to suspend or terminate your account, without prior notice, if your usage violates these terms or poses a risk to the integrity or security of our systems.

4. Payment, Cancellation, and Refunds

4.1. Ryft offers both free and paid hosting services. Free accounts are subject to certain limitations as specified on our website.

4.2. Paid services may be purchased using Ryft account credits. Ryft credits are account credit only, have no cash value, are non-transferable, and may only be used for Ryft services.

4.3. Credits may be added to your account after a payment is confirmed through our supported purchase process, including Discord ticket-based purchases. A purchase may be processed by a third-party payment processor or manually confirmed through an approved purchase channel. The processor, payment method, and any processor terms presented during the purchase apply to that transaction. We may require you to expressly confirm these Terms, our refund policy, your request for immediate activation, and your acknowledgement that cancellation or withdrawal rights may be limited or lost where permitted by law before credits or paid services are provided.

4.4. Immediate activation: By purchasing a server or asking us to activate one, you expressly request immediate provisioning and performance of the service. You acknowledge that once provisioning begins, your cancellation or withdrawal rights may be limited or lost where permitted by law.

4.5. Voluntary 24-hour refund window: Eligible paid server purchases may be eligible for a refund request only during the first 24 hours after the server purchase time. To request one, you must join our Discord server and open a support ticket within that window. Requests are reviewed manually. Approved refunds are issued as Ryft account credits only, not to the original payment method, except where applicable law requires otherwise.

4.6. Effect of refund: If a server purchase is refunded, the related server may be suspended, terminated, deleted, or otherwise made unavailable immediately.

4.7. Non-refundable cases: Refunds are not available for purchases older than 24 hours, promotional or free credits, suspended or terminated accounts, abuse, fraud, chargebacks, violations of these Terms, configuration issues, user error, or a change of mind, except where applicable law requires otherwise.

4.8. Legal rights: Nothing in these Terms limits any non-waivable consumer rights you may have under applicable law. Where the law requires a different refund method, cancellation period, or remedy, the legally required rule will apply.

4.9. Cancellations and disputes: Canceling a plan stops future service where applicable, but it does not create a refund right outside this policy. If you believe a charge is incorrect, contact us first so we can review it. Filing a chargeback without giving us a reasonable chance to investigate may result in immediate suspension or termination of your account.

5. Content and Intellectual Property

5.1. You agree not to host or transmit any content that is illegal, infringing, obscene, defamatory, or violates the rights of any third party.

5.2. Ryft reserves the right to remove or suspend any content that violates these terms or infringes upon the rights of others.

5.3. Ryft retains the right to review and assess any content hosted or transmitted on its platform if deemed suspicious or potentially violating these terms. In such cases, Ryft may, at its discretion, conduct a thorough examination of the content to ensure compliance with the stipulated guidelines. This includes but is not limited to investigating potential illegal activities, infringement issues, obscenity, or defamation concerns.

5.4. Users agree to cooperate with any review initiated by Ryft and provide necessary information or clarification regarding the content in question. Failure to cooperate may result in the removal or suspension of the content in question without further notice.

5.5. Ryft reserves the right to take appropriate actions, including the removal or suspension of content, based on the outcome of the review process, to maintain the integrity of its platform and uphold the rights of third parties.

Website Review and Security Monitoring

5.6. Ryft will automatically review websites being hosted on our platform using software that may or may not include artificial intelligence (AI) technologies. This automated review process is designed to ensure that no one hosts phishing websites, malware, or other dangerous content on our platform.

5.7. The automated review system may analyze website content, URLs, file structures, and other technical aspects to identify potentially harmful or illegal content. This includes but is not limited to phishing attempts, malware distribution, illegal content, or activities that violate these Terms of Service.

5.8. In cases where our automated systems or manual review identifies content that violates these terms, poses a security risk, or is potentially illegal, Ryft reserves the right to immediately suspend or terminate the hosting service and account access.

5.9. Users who violate these terms by hosting prohibited content, including but not limited to phishing websites, malware, or other dangerous content, will have their accounts permanently suspended and may be reported to appropriate authorities.

5.10. Ryft will cooperate with law enforcement and other appropriate authorities when required by law or when we believe such cooperation is necessary to protect our users, our platform, or the general public from harm.

5.11. By using our services, you acknowledge and consent to this automated review process and understand that violation of these terms may result in permanent suspension of your account and potential legal consequences.

6. Disclaimer of Warranties

6.1. Ryft provides its services on an "as is" and "as available" basis, without warranties of any kind, whether expressed or implied.

6.2. Ryft does not warrant that the services will be error-free or uninterrupted.

7. Limitation of Liability

7.1. In no event shall Ryft be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with the use of its services, even if advised of the possibility of such damages.

7.2. Ryft's total liability, regardless of the cause of action, shall be limited to the amount paid by you, if any, for the services during the six (6) months preceding the event giving rise to the liability.

8. Termination

8.1. Either party may terminate the services at any time, with or without cause, by providing written notice to the other party.

8.2. Upon termination, Ryft may delete all your data and content from its systems, and you will no longer have access to the services.

9. Modifications

9.1. Ryft reserves the right to modify or update these terms at any time. Changes will be effective upon posting on this website. It is your responsibility to review the TOS periodically.

9.2. Continued use of Ryft's services after any modifications to the TOS constitutes your acceptance of the revised terms.

10. Advertising and Data Collection

10.1. We may display advertisements on our website through third-party advertising networks. Any optional advertising or analytics cookies are activated only where you have provided the required consent through the Ryft privacy choices control. Google Analytics may still send limited cookieless measurement signals while consent is denied, as described in our Privacy Policy.

10.2. Ryft may collect and process certain personal data in accordance with our Privacy Policy. Required cookies may be used for authentication, security, and core service functionality.

10.3. Where consent is required, declining or withdrawing optional analytics consent does not prevent you from using Ryft's core services. You can change your optional analytics choice at any time through the privacy choices control.

10.4. Ryft is committed to protecting user privacy and complies with applicable data protection laws, including GDPR and CCPA where applicable.

10.5. Service email notices: When you sign in with Discord, Ryft may request and store the verified email address made available by Discord. We may use that address for account, billing, security, service, and legal notices, including material changes to these Terms or our Privacy Policy. Promotional emails require a separate opt-in where offered.

10.6. We do not knowingly collect personal information from children under 13 years of age.

10.7. Users have the right to access, correct, or delete their personal information by contacting us through the methods provided in our Privacy Policy.

11. Prohibited Content and Activities

11.1. Users are prohibited from engaging in any activity that violates our advertising partners' policies, including but not limited to:

• Clicking on ads or encouraging others to click on ads
• Using automated tools or software to generate artificial traffic
• Placing ads on pages containing prohibited content such as adult content, violence, or hate speech
• Modifying or interfering with ad code or ad behavior

11.2. Violation of these advertising policies may result in immediate termination of your account and access to our services.
